1. Use of the Service

1.2 The Service allows you to generate personalized comic content using artificial intelligence by uploading images and providing prompts ("Generated Content").

1.3 Generated Content is created under your direction and may vary in quality, accuracy, and style.

2. User Responsibility

2.1 You acknowledge and agree that all Generated Content and uploaded materials ("User Content") are solely your responsibility. You assume full liability for any claim, damage, or dispute arising from the creation, use, publication, or sharing of such content.

2.2 You agree not to use the Service to create, upload, or share content that is:

• illegal, obscene, pornographic, or violent
• infringing any intellectual property rights
• depicting real persons without their explicit consent
• promoting hate speech, harassment, or discrimination
• harmful, misleading, or abusive

2.3 By uploading images, you confirm that:

• you own the content or have permission to use it
• all identifiable individuals have given their consent

3. Copyright and Ownership

3.1 You retain ownership of the ideas and creative input you provide.

3.2 Filli S.r.l. retains all rights to the Service, including software, AI systems, algorithms, and brand assets.

3.3 You grant Filli S.r.l. a non-exclusive, royalty-free, worldwide license to use Generated Content and User Content for:

• operating and improving the Service
• training and enhancing AI models
• analytics and quality assurance
• showcasing content (including for marketing purposes)

You may withdraw this license by deleting your content or closing your account.

4. Moderation and Safety

We reserve the right to:

• review or remove content
• suspend or terminate accounts
• restrict access to the Service

5. Payments and Refunds

5.1 The Service may include paid features such as credits, subscriptions, or physical products.

5.2 No refunds will be issued for:

• completed AI generations
• unused credits
• subscription periods already started

5.3 Physical products (e.g. printed comics):

• are made on demand
• are non-refundable once production begins
• may be replaced only in case of defects or delivery issues

5.4 In case of technical issues preventing generation, users may contact support for review.

6. Privacy and Data Protection

Filli S.r.l. processes personal data in accordance with GDPR. Uploading images may involve processing personal data, including identifiable individuals. You are responsible for ensuring that all individuals depicted have provided consent. For more details, see our Privacy Policy.

7. AI Disclaimer

The Service uses artificial intelligence. You acknowledge that:

• Generated Content may be inaccurate or unexpected
• results are not guaranteed
• outputs may not be unique

Use of the Service is at your own risk.

8. Limitation of Liability

8.1 The Service is provided "as is" without warranties of any kind.

8.2 To the maximum extent permitted by law, Filli S.r.l. shall not be liable for:

• indirect or consequential damages
• loss of data, revenue, or reputation
• issues arising from Generated Content

8.3 Total liability is limited to the amount paid in the last 12 months or €50, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless Filli S.r.l. and its affiliates, employees, and partners from any claims arising from:

• your use of the Service
• your content
• violation of these Terms

10. Termination

We reserve the right to suspend or terminate access to the Service at any time if you violate these Terms or applicable laws.

11. Governing Law

These Terms are governed by the laws of Italy. Any disputes shall be subject to the exclusive jurisdiction of the courts of Milan, Italy.
